Policies,
Rules And Regulations Revised 9/25/2000 Statement of Purpose The Trinity Presbyterian Church (USA) of Cherry Hill, New Jersey (hereinafter designated "Trinity" and/or "Church"), in seeking an additional avenue of ministry to its congregation in Christ's name, in providing for the spiritual well being of its members, especially at times of death and bereavement, establishes the Trinity Columbarium ("Columbarium") to provide a final consecrated resting place and a gathering place for families and friends. Policies, Rules and Regulations for the Columbarium 1. The Session. The use and maintenance of the Columbarium is the responsibility of the Session of Trinity Presbyterian Church of Cherry ICII. From time to time the Session of the Church may delegate all or any part of this responsibility by appointing a Columbarium Committee. 2. Columbarium Record. Trinity will establish and maintain the Columbarium record ("Columbarium Record"). The Columbarium Record shall be the official record of: a. The policies, rules and regulations concerning the Columbarium; b. The original copy of each Columbarium application for a certificate of reservation ("Certificate of Reservation"); c. The number and location of each niche; d. Niches which have been allocated or reserved, and the names of the person's ("Licensee(s)") whose remains are to be inured pursuant to these Policies, Rules and Regulations; e. The current address of each Licensee, which shall be the sole responsibility of the Licensee to furnish to the Church and to keep current; and f. Other matters as the Church may designate. 1. Memorial Book. The Church will establish, maintain and securely keep a memorial book containing a page to be provided by the Licensee's family or next of kin, containing biographical and/or genealogical information, to be approved by the Columbarium Committee. 2. Inurnment. As used herein, the term "inurnment" means the placement of a crematory urn in a niche (not the placement of cremated remains in an urn). Arrangements for cremation and the placement of cremated remains in an urn shall be the responsibility of the Licensee. Any permits for inurnment required by IOC21 or state laws must be secured and furnished by the niche users, their family, or the Funeral Director employed by them. 3. Reservation of Niche Space. Upon approval by the Columbarium Committee of an application for a Certificate of Reservation for a niche and payment in full of the donation, the Licensee shall receive: a. a signed copy of the Certificate of Reservation which will identify the particular niche reserved, stating the right of use of the Licensee; b. a copy of these policies, rules and regulations governing the use and management of the Columbarium as they may be from time to time amended; and c. a diagram indicating the location of the reserved niche. 1.
Protection of Cremated Cremains. All
employees and members of Trinity (collectively "The Church") shall
have no liability excess of the cost of the niche, to the Licensee his/her
heirs and successors resulting from The Church's action or in-action related
in any way to: the Columbarium; the urn; the niche; any use, loss or damage
related to the Columbarium, the urn or the niche; the failure of the Church
to perform its duties set forth herein or from causes beyond The Church's
control, including, without limitation, acts of nature, war, thieves,
vandals, strikes, malicious mischief makers, explosions or order of any
military or civil authority, whether the damage be direct or collateral. 2.
Reservation of Title and Relocation.
Legal title to the Columbarium and to all niches therein shall be and at all
times remain in Trinity, its successors and assigns. Trinity reserves the
right to enlarge or remodel the Columbarium, or to remove the same and build
a new Columbarium in another location and abandon the use of the existing
Columbarium. In any of said events, if the reserved niche is affected, the
Church shall substitute for the reserved niche another niche of substantially
the same size and character, in which event the Licensee shall have the same
rights in such substitute niche. If the Columbarium is relocated to a
location other than on the present church property, the Church will move the
niche at its own expense and use reasonable efforts to notify by letter to
the Licensee or the Licensee's family. 3.
Non-assignability. The
niche and Certificate of Reservation and the 'license to use' evidenced by it
may not be assigned or otherwise transferred by the Licensee or the
Licensee's heirs or successors, and shall not be subject to the claims of
creditors. If it is determined that a niche will not be used, the donation
made therefore shall be forfeited and the reserved niche shall become and be
available for designation by the Church for use by others under the terms and
conditions of these policies. 4.
Termination. In
all events if the niche is not used within five years of the Licensee's death
the niche will revert back to Trinity and may be resold by Trinity. The
Licensee will not receive a refund of his donation if the niche is not used
within five years or the Licensee's death. 5.
Existence of Columbarium. It
is the intent of the Church to maintain the Columbarium in perpetuity.
However, if there is substantial damage to the present church building or the
Columbarium, or Trinity reasonably determines that it is not feasible to
continue the Columbarium, or the church ceases to exist, the Columbarium may
be discontinued. If the Columbarium is discontinued, all donors' privileges
shall terminate without any requirement for refunds to donors. In that case,
the Church or its successors shall use reasonable efforts to notify the
Licensee(s) or their successors by letter at the current address provided to
notify them of the relocation of the Columbarium and/or afford them the
opportunity to remove urns from the Columbarium and the Memorial Book. 6.
Removal of Cremated Remains. If
after inurnment, a family member or other authorized individual desires to
remove cremated remains entirely from the Columbarium, the request must be
made in writing to the Committee, setting forth the reasons and circumstances
for the request, including the authority of the person making the request. If
the Committee is satisfied that the request will not result in controversy
and has received an indemnity agreement from the requesting party, the
Committee may approve the request. If such request is granted, the entire
amount of the donation shall be forfeited and the Application and Certificate
of Reservation shall be canceled and returned. Thereafter the niche shall
become and be available for designation by the Church for the use of other
members or persons eligible under the terms and conditions of these policies. 7.
Amendment and Repeal.These
policies, rules and regulations may be amended or repealed by action of the
majority of the Session of Trinity. Any amendment or repeal will be effective
when entered in the Columbarium Record. The Church will use reasonable
efforts to notify the approved Licensees of such changes, by letter to the
address provided by the Licensees and on file with the Church. 8.
Limitation of Use.
Only cremated human person's remains may be inurned in a Columbarium niche.
The Columbarium facilities shall be open during the Sunday worship. In
addition, the Columbarium shall be open at such other times during normal
business hours as Trinity shall in its own discretion permit for those
desiring to come and pay their respects or to meditate. 9.
Eligibility.Use
of the Trinity Columbarium and availability of a niche is reserved for
members of Trinity, the Licensee’s family, Trinity's past and present Pastors
and members of the Presbyterian Church (USA) who have had close religious
ties with Trinity all in accord with N.J.S.A 8A:1-2 et. seg. as may be
amended from time to time. If there is any dispute as to the eligibility of
any person such eligibility shall be decided by the Columbarium Committee in
its sole discretion. The Columbarium Committee may from time to time further
define in writing who is eligible for inurnment. 10. Application. An
application to reserve a niche shall be made by completing an application for
a Certificate of Reservation and submitting it to the Columbarium Committee
through the office of the Church. Applications by families or individuals may
be made for several adjacent niches, if available. A separate
"Application for a Certificate of Reservation" shall be completed
for each niche, and such application shall name the person(s) who shall be
inurned in each niche. Up to two urns may be placed in a niche. 11. Designation
of the Use of a Niche. At the time an application for a
Certificate of Reservation is approved, the registered Licensee will
designate the person(s) by name and address whose remains may be inurned in
the niche. Should the Licensee, during his/her lifetime determine not to use
the niche, the Licensee shall so notify the Columbarium committee and shall
forfeit the donation. Should the Licensee desire to change the designation of
the person(s) whose cremated remains may be inurned, the Licensee must
complete an additional application for a Certificate of Reservation and
submit it to the Columbarium Committee. No addition to or change in a
designation will be effective until approved by the Columbarium Committee and
entered in the Columbarium Record. 12. Cost. The
Columbarium Committee with the approval of the Church Session shall establish
from time to time the amount of donation appropriate for the niche. Contact
the Church office for the current amount of the donation. A Certificate of
Reservation shall not be issued until the full amount of the donation shall
have been received by Trinity. 13. Engraved
Nameplate. The cost of reservation does not include the engraving
on the niche cover of the name(s) of the Licensee(s), with the dates of birth
and death. No other information is permitted. An additional charge shall be
made for this engraving by the engraver, which cost is the responsibility of
the Licensee or his family. The size, type and manner of the lettering will
be determined exclusively by the Committee. The provision of accurate names
and dates for the engraving is the sole responsibility of the Licensee or his
family. The engraving may not be done prior to the death of the
Licensee(s). 14. Opening
and Closing of Niches. The Church alone will arrange for and
supervise the opening and closing of the individual niche. Such cost is
included in the cost of reservation. 15. The Funeral Home. Costs for inurnment in the Columbarium are exclusive of any other costs which may be incurred at a Funeral home for the death, memorial service or cremation process. 21. Flowers. Only one arrangement of live potted or cut, natural Flowers may be placed at the Columbarium at the time of the funeral; no ribbons, artificial flowers or any other types of artifact are to be used at any time. The cost of flowers is borne by the family. Flowers may also be placed at the Columbarium site on or near the anniversary date of the death of a person inurned. The flowers will remain only one day and then may be used by the Church at its sole discretion. At Holy Day times (All Saints, Christmas, Easter and Pentecost) and Memorial Day, arrangements of flowers may be placed at the Columbarium site by Trinity, representing all who are inurned there.
